These terms and conditions (together with any other documents referred in these terms and conditions) (“Terms and Conditions”) set out the legal terms that apply to your use of our website http://www.salz-tokyo.com, any of its sub-domains and any other websites operated by us or on our behalf and any mobile device application or desktop application developed by us or on our behalf (together, the “Websites” and “Website” being a reference to any one of them) and the other services that we provide (the “Services”).

Please read these Terms and Conditions carefully and make sure that you understand them before using the Services. Please note that by using the Services, you agree to be bound by these Terms and Conditions. If you do not accept these Terms and Conditions, you will not be able to use the Services and you should leave the Website immediately. If you continue to use the Website or if you order products(the “Product” or/and “Item”), we will take this as your acceptance of these Terms and Conditions.

When we refer to “we”, “us” or “our”, we mean SALZ Tokyo. Where we refer to “you” or “your” we mean you, the person using the Services.

You shall acknowledge and agree that Websites may contain proprietary information including, with no limitation to copyrights, trademarks, service marks and patents protected by intellectual property laws and international intellectual property treaties unless otherwise specified. All texts, graphics, photos, content, the selection and arrangement thereof as well as the Products itself are SALZ Tokyo’s properties with all rights reserved, including with no limitation to any element specified by copy right marks“© SALZ Tokyo”. Any use of materials on Websites or the actual Products after purchase as if before purchase – including reproduction, modification, distribution, or republication without the prior written permission of SALZ Tokyo is strictly prohibited. Any third-party trademarks, service marks and logos are the property of their respective owners. Any further rights not specifically granted herein are reserved by SALZ Tokyo.

2. Privacy

When you use Services, SALZ Tokyo needs any necessary information to carry out our Services. If no contact information such as email, address, telephone number, SALZ Tokyo will not be able to send the Item ordered via SALZ Tokyo or Websites. As to contact information in the SALZ Tokyo membership including its email list, you agree that emails may be periodically sent to your email account. You may unsubscribe from our membership and email list at any time (you can contact us to unsubscribe). SALZ Tokyo does not use personal information to make automated decision. SALZ Tokyo is committed to protecting your privacy and will never sell or furnish your email address to third parties. Data controller hereunder is SALZ Tokyo. You can contact via this contact form. We may use cookies. Your information shall be kept as long as you do not specifically instruct us to delete.

3. Links To Other Websites

Websites may contain links to other websites of interest. However, once you have used these links to leave our site, you shall note that SALZ Tokyo does not have any control over that other website. Therefore, SALZ Tokyo can NOT be responsible whatsoever for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by the privacy statement herein. You shall exercise caution and look at the privacy statement applicable to the website in question.

The information contained in Websites is for general information purposes only. The information is provided by SALZ Tokyo and while our goal is to keep the website information current, SALZ Tokyo makes no guarantees of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the Websites or the information, Products, services, or related graphics contained on Websites for any purpose. Any reliance you place on such information is therefore strictly at your own risk.
In no event will SALZ Tokyo be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of Websites.

5. Minor

If you are a minor, you shall obtain the clear consent of your parent(s) or guardian(s) before any purchase or use of our Products.

6. Shop

SALZ Tokyo sells its own Items (either designed and/or hand-made/custom made by us), vintage/secondhand Items and/or Items from or jointly developed by us and other suppliers (called “Partners”). Even after your purchase, as if before purchase, any rights including, with no limitation to, copyrights thereof still exclusively belong to SALZ Tokyo, therefore reproduction, modification, distribution of the design and/or the Product itself is strictly prohibited unless otherwise specified. If you are unsure or have a question, please contact us for our suggestion before taking any action.

The age and material of vintage/antique Items in SALZ Tokyo are a rough estimation by the best knowledge and can NOT be certified and guaranteed.

Before you purchase, please pay enough attention to the photos and the descriptions of the Product listing including with no limitation to the sizes and if you have any doubt, please contact us before you purchase.
Even if you read such descriptions carefully, if the Product does not fit you at all, please contact us.

Vintage items in SALZ Tokyo might be protected by an insect repellent – therefore may have a scent. By purchasing from SALZ Tokyo, you agree to such a risk.

We recommend you to have us to put the sufficient insurance on your Item in case it is lost, damaged or stolen.

Even though SALZ Tokyo tries its best to ship Product within the time frame as SALZ Tokyo notifies you, the date of delivery to you is out of control of SALZ Tokyo, is in the control of the delivery vendor(s) and is not guaranteed in anyway by SALZ Tokyo.

Unless it is undoubtedly clear that it is due to our significant fault, you understand that we have no control that delivery company, custom office and its intermediary (ies) stop and confiscate the Item and/or charge the import tax thereon, in which case we can NOT be held responsible and you will be fully responsible to pay such a tax and relevant cost.

If your Product is not delivered to you in the time frame as SALZ Tokyo notifies you, you shall contact SALZ Tokyo about the non-delivery with Product details as soon as possible.

7. Return

For return, please refer to our FAQ section and return policy as below.

i.) If faulty product
We aim to provide you with Products of the highest standard and quality. If you have received a Product with a defect, please contact us via this contact form as soon as possible so we can guide you through the returns process and help resolve the problem as swiftly as possible. In order to assist the return process, you may be required to send us images of the damage, defect or fault for preliminary assessment.

If the Product is confirmed to have a defect, we will replace the Product or refund the Price of the Product to your original payment method at your request. If the Product is found not to have a defect or deemed out of warranty, we will ship the Product back to you.

It does not constitute a defect, if in our reasonable opinion; the Product has, following the sale to you, become of unacceptable quality due to fair wear and tear, misuse, failure to use in accordance with manufacturers’ instructions, using it in an abnormal way or failure to take reasonable care.

ii.) If change of mind
In addition to your rights in relation to faulty Products, you can return some certain Products
(a) within 7 days after its arrival;
(b) if the item has not been made to order, custom made sizing, color or material;
(c) unworn and unused with the original tags still attached if any; and
(d) in the original packaging, which must be in the original condition.
Please note that Products sealed for hygiene reasons can only be returned under change of mind return policy if the seal is intact.

Some Products may be excluded from the change of mind return policy (such as stocked brands other than SALZ Original items, that do not allow returns).

To ensure the returns are assessed and processed swiftly, you must follow the instructions set out under “How do I return an item” on.

Upon receiving and inspection of your return, we will contact you about next steps. Once determined the return is in compliance with clause 7 i. and ii., we will, at your request,
(a) refund the Price of the Product returned to your original payment method;
(b) provide you with a store credit worth of 110% of the Price of the Product returned (for the avoidance of doubt, the store credit is in the amount of your paid Price plus 10% extra; if you have used store credit or gift cards to pay for the full Price, we can only reinstate the original amount of store credit. If you have used store credit or gift cards to pay for part of the Price, we can reinstate the original amount of store credit you have used and offer you with additional store credit that is worth 110% non-store credit/gift cards payment you have made for the Product returned); or
(c) exchange the Product for similar type and price range.

However, we will not be able to refund any delivery fees that you have paid at purchase to have the Product shipped to you. If the return, in our reasonable opinion, is not in compliance with clause 7.i., we will contact you to ship the Product back to you and you will be liable for the shipping costs both to and from us.

8. Sales platform

For the appropriate platform, SALZ Tokyo is on the phase of feasible study to see which platform can serve our customers better including this Website and SALZ Tokyo Etsy shop where the rules stated at the Etsy Shop apply and relevant SNS including without limitation to Instagram, Twitter where these terms and conditions shall apply.
SALZ Tokyo is a licensed dealer under the laws of Japan regarding Secondhand Articles Dealer. Our Secondhand Articles Dealer Licence: No. 431090036584.

9. Force majeure

We shall not be liable for any breach of our obligations under these Terms and Conditions where we are hindered or prevented from carrying out our obligations by any cause outside our reasonable control, including by lightning, fire, flood, extremely severe weather, strike, lock-out, labour dispute, act of God, war, riot, civil commotion, malicious damage, failure of any telecommunications or computer system, compliance with any law, accident (or by any damage caused by any of such events).

10. Possible revision of these terms

Change of the Terms and Conditions: We reserve the right to amend these Terms and Conditions at any time. All amendments to these Terms and Conditions will be posted online. However, continued use of the Site will be deemed to constitute acceptance of the new Terms and Conditions.

11. Indemnity

You indemnify and hold us and our related entities, affiliates, and our and their respective officers, agents, and employees, harmless from and against any and all claims, demands, proceedings, losses and damages (actual, special and consequential) of every kind and nature, known and unknown, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms and Conditions or your breach of any law or the rights of a third party.

12. Jurisdiction and official language

1. The governing law shall be the Japanese law and these terms and separate terms shall be subject to Japanese law.
2. In the event of any dispute regarding the Terms or separate terms, exclusive and primary jurisdiction shall rest with Tokyo District Court.
3. Official language of this Terms and conditions is Japanese. If any conflict in understanding, the Japanese version supersedes any other version.
